Terms of Service

Welcome to Trail Trash. These Terms of Service (the "Terms") govern your access to and use of the website at betrailtrash.com, our training programs, community spaces, and any products or services we offer (together, the "Services"), all operated by SuperAXE LLC ("Trail Trash," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you don't agree, don't use the Services.

1. Who can use the Services

You must be at least 18 years old, or the age of majority where you live, to make purchases. Visitors under 18 may use the Services only with the involvement of a parent or guardian. By using the Services you confirm the information you give us is accurate and that you'll keep it that way.

2. Your account & the community

Some features (newsletter, community channels, programs) may require you to sign up or join a third-party platform such as Discord. You're responsible for activity under your account and for keeping your credentials secure. Our community is "no ego, all dirt" — be decent. We may suspend or remove access for harassment, hate, spam, illegal activity, or anything that wrecks the vibe for the pack.

3. Training programs & health disclaimer

Trail running and strength training carry inherent risks. Our programs, plans, and content are provided for general informational and educational purposes only and are not medical, fitness, or professional advice. We are not your doctor, coach-of-record, or healthcare provider. Consult a qualified professional before starting any program. You participate at your own risk and assume full responsibility for your health, safety, and decisions on and off the trail.

4. Orders & purchases

Prices, product descriptions, and availability are subject to change without notice. We may refuse or cancel any order, including for suspected fraud or pricing errors. Title and risk of loss for physical goods pass to you on delivery to the carrier. See our Shipping Policy and Refund & Returns Policy for details. Payments are processed by third-party providers; by purchasing, you also agree to their applicable terms.

5. Intellectual property

The Trail Trash name, logos, mascot, artwork, designs, copy, and the look and feel of the Services are owned by SuperAXE LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. Don't copy, resell, scrape, or create derivative works from our content without written permission.

6. Your content & submissions

If you submit stories, photos, comments, or other content (including via "Submit a Story"), you keep ownership of it, but you grant SuperAXE LLC a worldwide, royalty-free, non-exclusive license to use, reproduce, adapt, publish, and display that content in connection with Trail Trash and its promotion across any media. You represent that you have the rights to what you submit and that it doesn't violate anyone else's rights or any law.

7. Acceptable use

Don't misuse the Services. That includes attempting to breach security, interfering with the site, uploading malware, scraping at scale, infringing others' rights, or using the Services for anything unlawful.

8. Third-party links & services

The Services may link to third-party sites and tools (e.g., Discord, social platforms, payment and fulfillment providers). We don't control and aren't responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, SuperAXE LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury arising from your use of the Services or participation in any program. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 6 months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless SuperAXE LLC and its affiliates from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms.

12. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in San Diego County, California will have exclusive jurisdiction over any dispute, and you consent to venue there.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the revised Terms.

Privacy Policy

This Privacy Policy explains how SuperAXE LLC ("Trail Trash," "we," "us") collects, uses, and shares information when you use betrailtrash.com, the Trail Trash mobile app, and our other Services. We collect only what we need, and we don't sell your personal information.

1. Information we collect

  • Information you give us: your email and password when you create an account, your display handle, email addresses you submit to our waitlist or newsletter, messages you send us, and any content you submit (e.g., stories or photos).
  • Run & fitness data (app): when you track a run, we collect and store the run's date, distance, duration, pace, elevation gain, effort rating, and the GPS route of the run. See Section 2a for how location works.
  • Apple Health data (app, optional): if you choose to connect Apple Health, we import your workouts (activity type, date, distance, duration, elevation) so they appear in your run history. This is read-only and happens only after you grant permission in iOS. We never use Apple Health data for advertising or marketing, and we never share it with third parties for their own purposes.
  • Crew content (app): if you join or create a crew, we store your crew memberships and the chat messages you post. Messages are visible to other members of that crew. We also store reports and blocks you submit through our moderation tools.
  • Training progress (app): your program enrollment and workout completion progress.
  • Information collected automatically: device and browser type, IP address, pages viewed, referring links, and similar usage data on the website, gathered through cookies and similar technologies (see our Cookie Policy).
  • Stored only on your device (app): your goals, reminders, and app preferences stay on your phone — we don't upload them. Reminder notifications are scheduled locally on your device.

2. How we use information

  • To provide the app's features: recording your runs and routes, showing your stats and training progress, and powering crew chat.
  • To send the newsletter and launch updates you've asked for (you can opt out anytime).
  • To keep the community safe: reviewing reported crew messages and enforcing blocks and our community guidelines.
  • To operate, improve, and secure the Services, provide support, comply with legal obligations, and enforce our Terms.

2a. Location

The app uses your precise location only while you're tracking a run ("while using the app" permission) to measure distance, pace, and elevation and to draw your route on the map. Your recorded routes are stored with your account so you can see your run history. We don't collect your location in the background, we don't use it for advertising, and you can revoke location access anytime in iOS Settings (run tracking won't work without it).

2b. Your account & deleting your data

You can delete your account at any time in the app (Profile → Delete Account). This permanently deletes your account and the personal information associated with it — including your runs and routes, training progress, crew memberships, and chat messages. You can also email us at hello@superaxe.dev to request deletion.

3. How we share information

We share personal information with service providers who help us run Trail Trash — for example our database and hosting providers (your account, runs, and crew data are stored with Supabase; the website is hosted on Vercel), our email provider, and, if we sell products in the future, payment and fulfillment partners — only as needed to perform those services. Crew chat messages are shared with the members of your crew by design. We may also disclose information to comply with law, to protect our rights, or in connection with a business transfer. We do not sell your personal information, and we never share Apple Health or location data with third parties for advertising.

4. Cookies & tracking

We use cookies and similar technologies to run the site, remember preferences, and measure performance. You can control these through your browser and, where offered, our cookie controls. See the Cookie Policy for details.

5. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, and to opt out of certain processing. California residents (under the CCPA/CPRA) have the right to know what personal information we collect, to request deletion or correction, and to opt out of the "sale" or "sharing" of personal information — though we do not sell personal information. To exercise any right, email hello@superaxe.dev. We won't discriminate against you for exercising your rights.

6. Data retention & security

We keep personal information only as long as needed for the purposes described here or as required by law, then delete or de-identify it. We use reasonable technical and organizational measures to protect your information, but no method of transmission or storage is 100% secure.

7. Children's privacy

The Services aren't directed to children under 13, and we don't knowingly collect personal information from them. If you believe a child has given us information, contact us and we'll delete it.

8. Changes to this Policy

We may update this Policy; we'll revise the "Last updated" date above when we do. Significant changes may be communicated through the Services.

Refund & Returns Policy

We want you stoked on your gear. If something's not right, here's how returns and refunds work for purchases made on betrailtrash.com.

1. Return window

You may request a return within 30 days of delivery. Items must be unworn, unwashed, and in original condition with any tags attached.

2. How to start a return

Email hello@superaxe.dev with your order number and what you'd like to return or exchange. We'll send return instructions. Please don't send items back without contacting us first.

3. Refunds

Once we receive and inspect your return, we'll let you know if it's approved. Approved refunds are issued to your original payment method, typically within 5–10 business days of approval (your bank may take longer to post it). Original shipping charges are non-refundable unless the return is due to our error.

4. Exchanges

Need a different size or color? Start a return for the original item and place a new order, or ask us about an exchange when you contact support.

5. Damaged, defective, or wrong items

If your order arrives damaged, defective, or incorrect, contact us within 7 days of delivery with photos. We'll make it right with a replacement or refund at no cost to you.

6. Non-returnable items

Final-sale items, gift cards, and custom or personalized products can't be returned unless they arrive damaged or defective.

7. Return shipping

Unless the return is due to our error, you're responsible for return shipping costs. We recommend a trackable method — we can't guarantee we'll receive untracked returns.

Shipping Policy

How we get Trail Trash gear from our hands to your trail. Shipping options, rates, and timeframes are shown at checkout.

1. Order processing

Orders are typically processed within 1–3 business days. You'll get a confirmation email when your order is placed and another with tracking once it ships. Orders placed on weekends or holidays are processed the next business day.

2. Delivery times

Estimated delivery times depend on the method you choose and your location, and are estimates — not guarantees. Carrier delays, weather, and peak seasons can affect timing.

3. Shipping costs

Shipping is calculated at checkout based on destination and method. Any free-shipping thresholds or promotions will be shown at checkout.

4. International shipping

Where available, international orders may be subject to customs duties, taxes, and import fees charged by your country. These are your responsibility and are not included in our prices or shipping charges.

5. Tracking

Once shipped, you'll receive tracking info by email. Please allow a little time for tracking to update after a label is created.

6. Lost, stolen, or delayed packages

If your tracking shows delivered but you can't find your package, check around your address and with your carrier first. For lost or stolen shipments, contact us at hello@superaxe.dev and we'll help you work with the carrier.

7. Wrong addresses

Please double-check your shipping address at checkout. We're not responsible for orders sent to an incorrectly entered address; if a package is returned to us, we'll reship at your cost.

Cookie Policy

This Cookie Policy explains how SuperAXE LLC uses cookies and similar technologies on betrailtrash.com.

1. What cookies are

Cookies are small text files stored on your device when you visit a website. They help sites work, remember preferences, and understand how visitors use them. We also use similar technologies like pixels and local storage.

2. Types of cookies we use

  • Essential: required for the site to function (e.g., security, cart, and basic preferences). These can't be switched off in our systems.
  • Analytics & performance: help us understand how the site is used so we can improve it (for example, a web-analytics provider).
  • Marketing: used to measure and improve our campaigns and, where applicable, show relevant content (for example, a social-platform pixel).

3. Managing cookies

Accessibility Statement

Trail Trash is for every dirtbag — and that includes accessibility. SuperAXE LLC is committed to making betrailtrash.com usable for as many people as possible, regardless of ability or technology.

1. Our goal

We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, as a practical standard, and we work to improve the experience on an ongoing basis.

2. What we do

  • Use semantic, keyboard-navigable markup and meaningful alt text for images.
  • Aim for readable color contrast and clear, legible typography.
  • Provide text alternatives for important non-text content where feasible.

3. Known limitations

Some content — including certain artwork, embedded media, and third-party tools — may not yet be fully accessible. We're working on it, and we prioritize fixes based on impact.
